In Eromosele (Migration) [2024] AATA 1632 (5 June 2024), Kah Lawyers has successfully represented Mr Sylvester Eromosele from Nigeria to have his partner (subclass 801) visa cancellation revoked before the Administrative Appeals Tribunal (AAT) after his spouse (subclass 801) visa was cancelled by a delegate of the Minister for Home Affairs (the Minister) pursuant to s 109 (1) of the Migration Act 1958 (Cth) (the Act). The AAT decided to set aside the decision made by the Minister and substituted a decision not to cancel the applicant’s Subclass 801 (Spouse) visa on the basis that there was non-compliance by Mr Eromosele in the way described in the notice given under s 107 of the Act.
