In Naing (Migration) [2023] AATA 3648 (29 September 2023), Kah Lawyers has successfully represented Ms Myat Myat (Naing) from Myanmar in her Carer (subclass 836) visa application before the Administrative Appeals Tribunal (AAT) after her visa applications were refused twice by the Department of Home Affairs (the Department). The AAT decided to set aside a decision made by the Department on the basis that Ms Naing meets certain criteria for a Subclass 836 (Carer) visa according to Cl 836.212, cl 836.213, cl 836.221 and 836.227 of Schedule 2 to the Migration Regulations 1994.
